Ross’ Puzzle and the Chilean constitutional problem: An alternative account

Abstract

Taking as a starting point Alf Ross’ constitutional puzzle, Miriam Henríquez and George Lambeth defend the validity of the modification of the amending power established in chapter XV of the Chilean Constitution. This paper critizes Henríquez’s and Lambeth’s elaboration, introduces an alternative approach to the puzzle and analyzes, in the light of such interpretation, certain aspects of the chilean constitutional debate.
