Abstract

National security clauses appear in many international law treaties. The States have reserved matters of security since it is a particularly sensitive area that directly concerns their sovereignty. This paper deals with the issue of national security clauses in the field of human rights, and more specifically in the inter-American system for the protection of human rights. The development of human rights jurisprudence at the inter-American level has different characteristics compared to other areas of international law. It tries to find the principles through which the security clauses are to be interpreted in this area. These principles demonstrate the existence of objective interpretation criteria that exclude a merely political and subjective application by the State, a fact that constitutes a complete revolution in international law.
